Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied contract is signed on an Ahuriri rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

If the landlord or property manager is unable to supply the required information within 21 days from being informed of the request, they could be issued an infringement notice and be fined up to $750.

Additionally, there is also a penalty as much as $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is listed on the tenancy contract as the person leasing the property out which could be the name of the landlord or the property management company.

It is also crucial to remember that landlords who have multiple rental properties may receive even higher fines for non-compliance. Ahuriri Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory in all Ahuriri and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Ahuriri

Draughts can lead to dropping temperatures within houses. A damp house costs more to heat, which means wasting money and energy.

If a draught can be felt from unreasonable gaps or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a crack or a gap, then it’s probably a gap or an opening that requirements sealing in any way. Large cracks and gaps should be permanently stopped. Cracks that are greater than 3mm and allow air in or out from the house need to be sealed. In the case of an open fireplace isn’t used it could cause draughts, and should be blocked off. Landlords and property managers are accountable for making sure such draughts are eliminated as much as possible.

There is no need to block up intentional holes or gaps that are part of the building. For example, tiny gaps around doors and windows may be required to allow for the movement of the building as the home is heated and cools in order to let them be opened and closed rather than securing. Proper heating is crucial for healthy houses

Heating Ahuriri

Ahuriri rental properties need to have a stable source of heating which can warm the living space to at least 18degC even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements for it to be permanent (i.e., not portable) with at minimum 1.5 kW in heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to determine if your current installed heater(s) are adequate or whether you will require to "top up" with a new heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating that you provide is an electric heater or heat source, it must include the thermostat. This will make the heating more consistent and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, like small apartments an electric, fixed heater may suffice.

If the living area already has a fixed heating source, such as heat pumps, it may need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Ahuriri

Each liveable space in the rental property should have at least one openable window or exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should have an externally vented extractor to take moisture away.

A ventilation quality is all about acknowledging it is that dry air will be much easier to heat, and that an apartment that is well-ventilated will be less prone to developing mould and damp.

Bedrooms, living spaces, dining rooms, and kitchens are considered liveable spaces. Spaces that connect, such as the hallway are not considered liveable and therefore don’t need an opening window or door.

Every window, door or skylight requirements at least to open up to the outside and remain fixed in an open position, allowing the circulation of fresh air and ventilation.

All kitchens and bathrooms, and any other room in your home that has shower, bath or cooktop, or any other moisture generating item will need appropriate extractor fans which are vented towards the outside. Insulation Ahuriri

Ceiling and underfloor insulation is a requirement on all rental houses from 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the subfloor space might need to be filled with or replaced.
