Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on an Anderson Park rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they can receive an infringement notification and be fined as high as $750.

In addition, there is also a penalty of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is named on the tenancy contract as the person renting the property, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate when the tenancy agreement is completed, and should be kept updated throughout the tenancy as any associated work has been completed.

It is crucial to note that a landlord who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down for severe violations, and landlords who own more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Anderson Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Anderson Park and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Adequate heaters are crucial for well-being homes

Heating Anderson Park

Rental properties in Anderson Park require a reliable source of heat that can heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest winter days. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like small apartments the smaller fixed electric heater might be enough.

If the living area already has a permanent heating source, such as heat pumps, it might just require an upgrade in order to comply with the standards.
