Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for an Eskdale rental property, all Healthy Homes compliance items need to be finished within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on the Eskdale rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, there may be an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the information requested within 21 days of being informed of the request, they may receive an infringement notification and be fined up to $750.

In addition, there is also a penalty of approximately $900 for property owners or property managers who offer a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be current when the tenancy agreement is completed, and must be updated through the tenancy period as relevant work gets completed.

It’s also crucial to keep in mind that a landlord who own multiple rental properties may face additional fines for non-compliance. The harshest penalties are handed down for the most serious violations, and landlords who own six or more properties can be fined up to $50,000 and as high as $100,000 in hearings.

Eskdale Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Eskdale and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

If you are able to feel external air flowing in or an unobstructed draught coming from a hole or gap, then it’s most likely a gap or an opening that requirements sealing in any way. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that let air into or out within the house require sealing. For example, if an open fireplace isn’t used it could cause draughts, and should be sealed from. Landlords and property managers are responsible for making sure such draughts are eliminated as far as imaginable.

You don’t need to block gaps or holes that are part of the building. For instance, small gaps around doors and windows could be required to allow movement of the building as the home is heated and cools so that they can still be closed and opened rather instead of being stuck. Proper heating is crucial to ensure well-being houses

Heating Eskdale

Rental properties in Eskdale require a reliable heating source which can warm the largest or main living room to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to be fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living room. For most properties, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If the living area already has a fixed heating source like a heat pump, then it could need a top up to be able to meet the standards. Certain kinds of heaters aren’t able to be used to meet the quality as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Eskdale

Insulation Eskdale

Underfloor and ceiling insulation is required on all rental homes since July 1, 2019. Property managers and landlords have to ensure the insulation meets standards that are in line with the latest quality. In some instances, existing ceiling insulation or insulation in the sub floor space may need to be topped up or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of dampness and mould, and also makes more easy to the house to keep the heat.
