Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Fernhill rental property, all Healthy Homes compliance items must be done by the end of 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on a Fernhill rental property, all Healthy Homes compliance work must be finished within 90 days.

Inability to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to provide the information requested within 21 days from receiving the request, they may receive an infringement notice and be fined upto $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is whoever is identified on the tenancy agreement as being the person renting the property It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.

It’s also important to keep in mind that landlords who have several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Fernhill Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory throughout Fernhill and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standard that apply or will be in force during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Fernhill

Fernhill rental properties need to have a stable heating source that can heat the largest or main living space to a minimum of 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

All landlords and property managers must ensure that the insulation is in line with standards that are in line with the latest standard.
