Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Frasertown rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Frasertown rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Furthermore, there’s an additional fine of as much as $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is listed on the tenancy agreement as the person who is who is letting the property and it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It is updated through the tenancy period as associated work has been completed.

It is also crucial to keep in mind that landlords with multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for serious breaches. Landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearings.

Frasertown Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Frasertown and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to all Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

Starting 1 July 2021

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Frasertown

Rental properties in Frasertown require a reliable heating source that is able to heat the main or largest living space to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs for it to be permanent (i.e. not portable) with at least 1.5 horsepower in capacity and have the minimum heating capacity needed for the main living room. In certain situations, like apartments with small spaces, a smaller fixed electric heater could be enough.

If the main living room already has a fixed heating source like heat pumps, it may need a top up to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard because they’re costly, not affordable to run, and/or unsafe to run.
