Fines for Failing to Comply
Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Greenmeadows rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.
Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Greenmeadows rental property, all Healthy Homes compliance work must be finished within 90 days.
Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.
Anyone can request details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the required information within 21 days of being informed of the request, they can receive an infringement letter and be fined upto $750.
Furthermore, there’s an additional fine of as much as $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the person who is named on the tenancy contract as the person letting the property out and it could be the name of the landlord, or the company that manages the property.
All the information on the Statement of Compliance requirements to be current when the tenancy contract is completed, and must be updated during the entire tenancy, as necessary work related to it is finished.
It is important to note that landlords who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are given for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in hearings.
