Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Haumoana rental property, all Healthy Homes compliance items have to be finished within 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Haumoana rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to provide the required information within 21 days of getting the notice, the tenant will receive an infringement notification and be fined up to $750.

Furthermore, there’s an additional fine of as much as $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property which could be the name of the landlord, or the property management company.

It’s also crucial to be aware that landlords with multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for the most serious violations. When Do I require to be in compliance with The Healthy Homes Standards?

Haumoana Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Haumoana and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate compliance with all Healthy Homes Standard that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Haumoana

Rental properties in Haumoana require a reliable source of heating that is able to heat the living room to at least 18degC even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

Ventilation Haumoana
