Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Havelock North Central rental property, all Healthy Homes compliance items have to be done by the end of 90 days.

From the 1st of July in 2021, when a new or renewed tenancy is signed on the Havelock North Central rental property, all Healthy Homes compliance work must be finished inside of 90 days.

The person who is liable to pay this fine is the one who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.

It is important to keep in mind that a landlord who manage multiple rental properties may face additional fines for non-compliance. The harshest penalties are reserved for the most serious violations. Those who have six or more properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Havelock North Central and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

Heating Havelock North Central

Havelock North Central rental properties should have a permanent source of heating that is able to heat the largest or main living room to at least 18degC, even during the winter coldest days.
