Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Havelock North Central rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

The information contained in the Statement of Compliance requirements to be current when the tenancy contract is completed, and must be updated during the entire tenancy, as associated work has been completed.

It is also important to note that landlords with multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for serious breaches. Landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Havelock North Central and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to all Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply to the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Havelock North Central

Havelock North Central rental properties should have a permanent source of heat which can warm the living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs for it to be permanent (i.e., not portable), at minimum 1.5 kW in heating capacity, and meet the minimum heating capacity needed to heat the living space in general.
