Fines for Failing to Comply

All the information on the Statement of Compliance needs to be current at the time that the tenancy agreement is signed. It must be updated through the tenancy period as relevant work gets completed.

It is important to keep in mind that landlords who manage multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory in all Jervoistown and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

Starting 1 July 2021

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
