Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Kingsley-Chatham rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

From the 1st of July in 2021, once a new or renewed contract is signed on the Kingsley-Chatham rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not provide the information requested within 21 days from having received the inquiry, they will receive an infringement notice and be fined upto $750.

In addition, there’s also a penalty of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be up-to-date when the tenancy agreement is signed. It must be updated during the entire tenancy, as associated work has been completed.

It is also important to keep in mind that landlords who own several rental properties can face greater penalties for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearings.

Kingsley-Chatham Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required to all Kingsley-Chatham and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Kingsley-Chatham

Kingsley-Chatham rental properties should have a permanent heating source that is able to heat the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs to remain fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and meet the minimum capacity for heating required in the living area. Fires that are open and unflued heaters, such as small portable LPG bottle heaters aren’t considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it should be equipped with a thermostat. This will help make the heating more uniform and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If your living space already has a central heating source, like a heat pump, then it may require an upgrade to meet the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.
