Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Lochain rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

It is also important to be aware that landlords who manage multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down for serious violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Lochain Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory to all Lochain and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.

Lochain rental properties need to have a stable heating source which can warm the living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year.
