From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Lochain rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the necessary information within 21 days from having received the inquiry, they may be issued an infringement notice and could be fined up to $750.

In addition, there is also a penalty approximately $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is renting the property which could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance needs to be accurate when the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s important to remember that landlords who manage several rental properties can face even higher fines for non-compliance. The highest penalties are handed down only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Unreasonable Gaps & Holes

Draught Stopping Lochain

Draughts are a major cause of less temperature in houses. A draughty house is more expensive to heat, which results in wasting energy and incurring higher costs.

If a draught could be felt through gaps that are too large or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a hole or gap or crack, then it’s most likely a gap or hole that requirements sealing in some way. Cracks and gaps that are large should be sealed permanently. The gaps that exceed 3mm that let air into or out into your house need to be sealed. For example, if the open fireplace isn’t being used, it can cause draughts and should be blocked off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as much as possible.

There is no require to block off gaps or holes in the building. For example, tiny gaps around windows and doors could be necessary to allow movement of the building when the home gets warmer and cooler, so that they can still be closed and opened instead of than securing. We will test all doors and windows in your Healthy Homes assessment of your rental property.

Heating Lochain

Lochain rental properties should have a permanent heating source that can heat the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements for it to be permanent (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living room. A Heating Assessment Tool may be used to check if the installed heater(s) are adequate or whether you will require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters such as the portable LPG bottle heaters are not considered to be acceptable heating options under the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it should include an thermostat. This will help make your heating more consistent and effective. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like small apartments small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a central heating source, such as heat pumps, it may need some additional energy in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality because they’re costly, not affordable to run, and/or unsafe to run.

Ventilation Lochain

Each liveable space in the rental property should have at least one opening window or exterior door to provide natural ventilation. In addition, high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor to take moisture away.

This ventilation standard is all about understanding how dried air can be less difficult to heat and that the property that is properly ventilated is less likely to grow mould and damp.

Bedrooms, living rooms kitchens, and dining rooms are all considered living spaces. Connecting spaces like the hallway are not considered liveable , and thus do not require an opening window or door.

Each window, door , or skylight requirements to have the ability to open up to the outside and remain at an open angle in order to allow for fresh air circulation and air flow.

The bathrooms in all kitchens and any other room in your home with shower, bath or cooktop, or any other moisture generating item will need proper extractor fan systems which are vented to the outside. We offer a Healthy Homes Assessment service will verify that there is enough ventilation throughout the living spaces with the right extractor fan in areas with high moisture.

Insulation Lochain

Ceiling and underfloor insulation is mandatory on all rental homes as of July 1st, 2019. All landlords and property managers have to make sure that the insulation is in line with the new quality. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be replaced or replaced.

A properly insulated home will reduce the risk of condensation, and decrease the risk of dampness and mould, and also makes much easier for the home to hold the heat.

Insulation needs to be in compliance with the R-values for your area

The "R" stands for thermal resistance, and is a measure of how well the insulation resists heat flow. The more R-value is higher, the better the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Lochain Moisture Ingress & Drainage

Protecting your rental property from dampness isn’t just about the inside but you must ensure there is somewhere for rain, surface as well as groundwater to move and stop it from coming into the building. When it is damp and moisture, it’s usually what you don’t see that could be a huge problem that can cause damage to your investment and affecting your tenant’s health.

Rental properties must have effective drainage to eliminate rainwater, storm water, and ground water. This includes an appropriate runoff or outfall. Making sure that the water is able to go, and that it doesn’t sit beneath buildings is an essential part of maintaining your property’s dry.

Alongside a drainage system to prevent water ingress, if the apartment has an enclosed gap between floorboards and the surface, a ground moisture barrier should be put in place if it is reasonably practicable to do so.

The ground-moisture barrier typically an insulating sheet of polythene laid over the ground, in order to block any moisture in the ground from rising into the home. It also helps in preventing moisture damage to the underfloor insulation.
