Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Longlands rental property, all Healthy Homes compliance work have to be finished within 90 days.
From the 1st of July in 2021, when a new or renewed contract is signed on a Longlands rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to meet all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, there may be an additional fine or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t provide the required information within 21 days from having received the inquiry, they may be issued an infringement notice and be fined as high as $750.
In addition, there is also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is identified on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord or the property management company.
All information in the Compliance Statement requirements to be correct when the tenancy contract is signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.
It is also important to keep in mind that landlords who own multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down for severe breaches, and landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in hearing claims.
