Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed for a Longlands rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

Since the 1st July of 2021, once a new or renewed contract is signed on the Longlands rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

If the landlord or property manager fails to provide the information requested within 21 days of getting the notice, the tenant could receive an infringement letter and could be fined up to $750.

It is also crucial to remember that landlords who manage several rental properties can face more severe penalties for not complying. The highest penalties are reserved for severe breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Longlands Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory in all Longlands and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the compliance with each Healthy Homes Standards that apply or will be applied during the tenancy of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Draught Stopping Longlands

Draughts are a major cause of low temperatures inside homes. A humid home costs more to heat, which results in wasting energy and incurring higher costs.

What are unreasonable gaps and holes?

If you can feel external air coming in or a clear draught from a hole or gap that is, it is probably a gap or hole that requirements sealing in somehow. Cracks and gaps that are large should be fixed permanently. The gaps that exceed 3mm that allow air in or out into your home require sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and should be shut from. Landlords and property managers are responsible for ensuring that such draughts are squelched as far as possible.

You don’t need to block off gaps or holes that are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the structure as the house is heated and cools to allow them to be closed and opened rather instead of being stuck. Proper heating is important to ensure healthy houses

Heating Longlands

Rental properties in Longlands need to have a stable source of heat that can heat the main or largest living area to at minimum 18degC, even during the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs for it to be permanent (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to determine whether your current installed heater(s) are adequate or whether you will require to "top up" by adding a second heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it must be equipped with a thermostat. This makes the heating more uniform and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like small apartment buildings the smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source such as a heat pump, then it might just need an update to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Longlands

Insulation Longlands

Underfloor and ceiling insulation is mandatory on all rental homes since 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with current standard. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be filled with or replaced.
