Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Mahora rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

From the 1st of July in 2021, if a new or renewed contract is signed on the Mahora rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Mahora Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory in all Mahora and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to any Healthy Homes Standard that apply or will apply during the tenure of your rental home.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Mahora

Mahora rental properties need to have a stable heating source that can warm the living space to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements that it be permanently fixed (i.e., not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required in the living area. In some instances, like small apartments, a smaller fixed electric heater could be enough.
