Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords now have to ensure their Maraenui rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Maraenui rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement, there may be an additional fine or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the property they are living in. If the the property manager doesn’t provide the required information within 21 days from being informed of the request, they can receive an infringement notice and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers who provide a false or misleading Healthy Homes Compliance Statement or other information. The person responsible for this fine is the one who is named on the tenancy agreement as the person who is who is letting the property which could be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is completed, and must be updated throughout the duration of the tenancy when any associated work has been completed.

It’s also important to note that a landlord who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for severe violations, and landlords who own more than six properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Maraenui Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory in all Maraenui and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with each Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Maraenui

Maraenui rental properties must have a fixed source of heating that can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e., not portable) and at least 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living space. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. In certain situations, like small apartments small apartments, a smaller electric fixed heater might be enough.

If the main living room already has a fixed heating source like a heat pump, then it could need an upgrade in order to comply with the standards. Some types of heaters can’t be used to meet the quality since they’re either inefficient, unaffordable to operate or are unsafe to operate.
