Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? The landlords are now required to make sure that their Mayfair rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Mayfair rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included in a new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to supply the information requested within 21 days from receiving the request, they may receive an infringement notice and be fined as high as $750.

Furthermore, there’s an additional fine of approximately $900 for landlords or property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It is also crucial to be aware that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down only for serious violations. Those who have six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Mayfair Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required throughout Mayfair and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standard that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Draught Stopping Mayfair

Draughts are a major cause of less temperature in homes. A damp home will cost more to heat, meaning wasting energy and incurring higher costs.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a crack or a gap, then it’s likely to be a gap or hole that requirements sealing in somehow. Large cracks and gaps should be permanently stopped. Cracks that are greater than 3mm and let air into or out within the home require seals. In the case of an open fireplace is not in use, it can cause draughts and should be sealed off. Property managers and landlords are accountable for ensuring that these draughts are stopped whenever imaginable.

There is no require to block up intentional gaps or holes that are part of the construction. Adequate heaters are important to ensure well-being homes

Heating Mayfair

Mayfair rental properties need to have a stable source of heat that can heat the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to check if the fix heater(s) are sufficient or whether you will require to top up by adding a second heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters are not considered to be safe heating options in those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump it should be equipped with the thermostat. This will help make the heating more reliable and efficient. In most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like small apartments the smaller fixed electric heater may suffice.

If the main living room already has a permanent heating source such as the heat pump, it might require some additional energy to meet the standards. Certain types of heaters cannot be utilised to meet the standard since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Mayfair

Every living space of the rental property should contain at minimum one open windows or an exterior door to provide natural ventilation. Furthermore, moist areas such as kitchens or bathrooms need to have an externally vented extractor fan that can take moisture away.

Insulation Mayfair

Underfloor and ceiling insulation is a requirement in all rental houses from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with current quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space may require to be topped up or replaced.

A house that is well-insulated can help control condensation and reduce the chances of mould and dampness and it will make an easier task for the house to keep heat.
