Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Meeanee rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Meeanee rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

The person responsible to pay this fine is the one who is identified on the tenancy agreement as being the person who is letting the property, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.

It is also crucial to be aware that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.

When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Meeanee Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required throughout Meeanee and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records of their the compliance with all Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Rental properties in Meeanee require a reliable heating source that is able to heat the principal or the biggest living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

If the main living room already has a central heating source, such as a heat pump, then it might require a top up to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ceiling and underfloor insulation is mandatory for all rent homes as of July 1st, 2019. Property managers and landlords have to ensure the insulation meets current quality. In some cases, an existing insulation on the ceiling or in the subfloor space may require to be topped up or replaced.
