Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Napier South rental property, all Healthy Homes compliance work must be completed within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Napier South rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, there may be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager does not provide the information requested within 21 days of getting the notice, the tenant could be issued an infringement notice and be fined up to $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is listed on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s important to keep in mind that a landlord with multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for serious breaches, and landlords with six or more properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies established between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory in all Napier South and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with the Healthy Homes Standards that apply or will be applied to their rental properties.

Starting 1 July 2021

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
