Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Napier South rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

All the information on the Compliance Statement needs to be accurate when the tenancy agreement is signed, and ideally it should be maintained through the tenancy period as related work is completed.

It is crucial to note that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are handed down for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Napier South and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate compliance with the Healthy Homes Standards that apply or will be applicable to your rental home.

From 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Napier South

Napier South rental properties require a reliable source of heating that is able to heat the main or largest living space to at least 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to be fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like small apartment buildings, a smaller fixed electric heater may be sufficient.

If your living space already has a permanent heating source, such as an air conditioner, it may require an upgrade to be able to meet the standards. Certain types of heaters cannot be used to achieve the standard as they are either expensive, inefficient or unsafe to operate.
