Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Pakowhai rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on the Pakowhai rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager is unable to provide the necessary information within 21 days of being informed of the request, they can receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty up to $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is named on the lease contract as the person leasing the property out, so it could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be accurate when the tenancy contract is completed, and should be kept updated throughout the duration of the tenancy when any related work is completed.

It’s also important to keep in mind that a landlord who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are reserved for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Pakowhai Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Pakowhai and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with the Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
