Fines for Failing to Comply
From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Parkvale rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.
Since the 1st July of 2021, when a new or renewed tenancy is signed on the Parkvale rental property, all Healthy Homes compliance work must be completed inside of 90 days.
Failure to adhere to each of Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there could be an additional fine or violation fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not supply the information requested within 21 days of receiving the request, they can receive an infringement letter and be fined as high as $750.
In addition, there is also a fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as being the person who is letting the property which could be the name of the landlord as well as the company that manages the property.
The information contained in the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it should be maintained through the tenancy period as necessary work related to it is finished.
It is also important to note that landlords who manage multiple rental properties may receive additional fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.
