Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to ensure their Pirimai rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals must be completely compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Pirimai rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for the Pirimai rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t supply the required information within 21 days from receiving the request, they will receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty of up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is listed on the tenancy contract as the person who is letting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and must be updated throughout the tenancy as any related work is completed.

It’s also crucial to remember that landlords who own several rental properties can face additional fines for non-compliance. The harshest penalties are given for serious breaches. Landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.

Pirimai Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Pirimai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

If you can feel external air flowing in or a clear draught from a hole or gap and you are able to feel it, it is probably a gap or an opening that requirements sealing in any way. For example, if an open fireplace isn’t being used, it may cause draughts and should be sealed off. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed whenever imaginable.

You don’t require to block off holes or gaps that are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for the movement of the building as the house gets warmer and cooler, in order to let them be opened and closed rather instead of being stuck. Heating Pirimai

Pirimai rental properties should have a permanent source of heat which can warm the principal or the biggest living room to at least 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs to be fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or if you’ll need to "top up" with a new heater. Property managers and landlords should ensure that the insulation is up to standards that are in line with the latest standard.
