Fines for Failing to Comply

When will I require to be in compliance with requirements of the Healthy Homes Standards?

Poraiti Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement in all Poraiti and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their compliance with the Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Poraiti

Poraiti rental properties must have a fixed source of heating that can heat the main or largest living space to a minimum of 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity for the main living space. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like small apartment buildings the smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source, like the heat pump, it may need a top up to meet the standards. Some types of heaters can’t be used to comply with the standard because they’re costly, not affordable to run, and/or unhealthy to run.
