Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Roys Hill rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to remember that a landlord with multiple rental properties may receive additional fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own at least six rental properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Tenancies established from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory for all Roys Hill and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
