Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Roys Hill rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

If the property manager is unable to provide the required information within 21 days of getting the notice, the tenant will receive an infringement notification and be fined upto $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is listed on the tenancy contract as the person leasing the property out, so it could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be accurate when the tenancy agreement is signed. It should be kept updated during the entire tenancy, as associated work has been completed.

It’s crucial to keep in mind that landlords who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Roys Hill Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Roys Hill and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Roys Hill

Roys Hill rental properties should have a permanent heating source which can warm the main or largest living area to at minimum 18degC, even during the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs for it to be permanent (i.e., not portable) and at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living room. In most houses, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in some cases such as small apartments an electric, fixed heater could be enough.

If the living area already has a permanent heating source, like a heat pump, then it could require a top up to meet the standards. Certain kinds of heaters aren’t able to be used to meet the standard since they’re either expensive, inefficient and/or unsafe to run.
