Did you have any idea that the Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to make sure that their Te Hauke rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Te Hauke rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied lease is entered into on the Te Hauke rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they will receive an infringement notice and be fined upto $750.

In addition, there’s also a penalty of approximately $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the tenancy contract as the person renting the property, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be correct at the time that the tenancy agreement is completed, and should be kept updated throughout the duration of the tenancy when any related work is completed.

It’s crucial to remember that landlords who manage several rental properties can face additional fines for non-compliance. The highest penalties are handed down for the most serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in hearings.

Te Hauke Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Te Hauke and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove conformance with any Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Te Hauke

Draughts are a major cause of lower temperatures in houses. A draughty home is more expensive to heat, resulting in wasted money and energy.

If a draught could be perceived as a result of gaps or holes, it requirements to be closed.

What are unreasonable gaps and holes?

If you can feel external air coming in or an unobstructed draught coming out of a hole or gap and you are able to feel it, it’s probably a gap or hole which needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that let air in or out from the house require seals. For example, if an open fireplace isn’t in use it can create draughts. This should be shut off. Property managers and landlords are responsible for ensuring such draughts are eliminated as far as possible.

You don’t need to block holes or gaps that are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement within the building as the house warms and cools in order to let them be opened and closed rather than securing. Adequate heaters are important to ensure well-being houses

Heating Te Hauke

Te Hauke rental properties should have a permanent source of heating which can warm the living space to a minimum of 18degC, even during the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to be fixed (i.e., not portable) that is, at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed in the living area. The Heating Assessment Tool can be used to check if the current permanent heater(s) are sufficient or whether you will need to ‘top up’ by adding a second heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters aren’t considered acceptable heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, then it must have a thermostat. This will help make the heating more consistent and effective. For most properties, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a fixed heating source, like heat pumps, it might just need an upgrade to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Te Hauke

Each liveable space in a rental property must contain at minimum one open window or exterior door to offer natural airflow. In addition, humid areas like kitchens and bathrooms should have an externally vented extractor fan that can get rid of moisture.

The ventilation standard is all about recognising how dried air can be less difficult to heat and the property that is properly ventilated will be less prone to developing mould and damp.

Bedrooms, living rooms kitchens and dining rooms are considered to be liveable spaces. Connecting spaces like the hallways are not liveable and don’t need an opening door or window.

Each door, window or the skylight requirements to be able to open up to the outside, and stay set in an opening position, allowing ventilation and fresh air ventilation.

All bathrooms and kitchens and any other area in your property with shower, bath and cooktop or another moisture generating item will need adequate extractor fans that can be vented to the outside. Insulation Te Hauke

Ceiling and underfloor insulation is required in all rental homes from 1 July 2019. Property managers and landlords must make sure that the insulation is in line with this new quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.

A properly insulated home will reduce the risk of condensation and reduce the chances of mould and dampness and will also make more easy to the household to retain the heat.

The "R" signifies thermal resistance, and is a measure of how well the insulation withstands heat flow. The greater the R-value, the higher the standard of insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – all of the North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Te Hauke Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the interior of the building It’s about having to make sure there is somewhere to allow surface, rain and ground water to go, and prevent it from getting into the building. When it concerns damp and moisture it’s typically what you don’t see that could become a major issue and end up causing damages to your investment and harming the tenant’s health.

Rental properties must have effective drainage to remove rainwater, storm water, and ground water, which includes an appropriate outfall or runoff. Making sure that the water has a proper place to go, and also that it doesn’t get sucked into buildings is a vital aspect of keeping your property dry.

In addition to a drainage system to prevent water ingress, if the apartment has an enclosed gap between your flooring and the ground, a ground water barrier must be constructed if it’s reasonably practicable to do so.
