Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Te Mata Hills rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied Tenancy is signed for the Te Mata Hills rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in the renewal, new or amended tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they live in. The person who is responsible for this fine is whoever is listed on the tenancy agreement as the person who is renting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate when the tenancy contract is signed. It is updated throughout the duration of the tenancy when any associated work has been completed.

It is also important to be aware that landlords who own multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Te Mata Hills and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Te Mata Hills

Te Mata Hills rental properties require a reliable source of heat which can warm the main or largest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.
