Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Te Mata Hills rental property, all Healthy Homes compliance work must be finished within 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Te Mata Hills rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, there could be an additional fine or infringement fee.

The person who is responsible for this fine is the one who is named on the lease agreement as being the person who is letting the property which could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it should be kept updated during the entire tenancy, as associated work has been completed.

It’s also crucial to note that landlords who manage multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down for the most serious breaches. Landlords with more than six properties could be fined as high as $50,000, and as much as $100,000 in hearings.

Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Te Mata Hills and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties comply to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Heating Te Mata Hills

Te Mata Hills rental properties require a reliable source of heating that can warm the largest or main living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements for it to be permanent (i.e. not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living room. A Heating Assessment Tool can be used to check if the permanent heater(s) are adequate or whether you will require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump then it must have a thermostat. This makes the heating more consistent and effective. For the majority of homes, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a permanent heating source like heat pumps, it might need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.
