Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Waipawa rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

From the 1st of July in 2021, once a new or renewed tenancy is signed on the Waipawa rental property, all Healthy Homes compliance work must be completed inside of 90 days.

It’s also important to note that a landlord who own multiple rental properties could face more severe penalties for not complying. The highest penalties are handed down for serious violations, and landlords who own at least six rental properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Waipawa Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Waipawa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
