Fines for Failing to Comply
From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed for a Twyford rental property, all Healthy Homes compliance work need to be done inside of 90 days.
From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Twyford rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to meet any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager fails to provide the required information within 21 days of receiving the request, they can be issued an infringement notice and could be fined up to $750.
In addition, there’s an additional fine of approximately $900 for landlords or property managers who offer a false or incorrect Healthy Homes Compliance Statement or any other information. The person liable for this fine is the one who is named on the lease agreement as the one who is renting the property and it could be the name of the landlord, or the property management company.
All the information on the Compliance Statement requirements to be correct when the tenancy agreement is signed. It is updated during the entire tenancy, as associated work has been completed.
It’s important to be aware that landlords who manage multiple rental properties could face more severe penalties for not complying. The harshest penalties are handed down for serious breaches. Landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.
